The House of Commons has stated that it was mandatory to increase the salary of a Member of Parliament from New Brunswick, regardless of his personal preference. Eric Janse, the House clerk, emphasized in a court affidavit that all MPs must receive the specified payments as outlined in the legislation to comply with the law and avoid any legal complications.
Mike Dawson, the Conservative MP for Miramichi-Grand Lake, had sought a judicial review in Federal Court to challenge the $8,800 raise that Parliament intended to award him. In response, Janse filed an affidavit last month asserting that the sessional allowance for Dawson must align with the amounts mandated by the Parliament of Canada Act, including any annual adjustments.
Granting Dawson the option to reject the raise would necessitate special administrative efforts by House staff to calculate and maintain a separate sessional allowance specifically for him on an annual basis throughout his tenure as an MP. The base salary for MPs was $208,900 last year and increased to $217,700 on April 1, in accordance with federal legislation that links MP salaries to a formula based on private-sector wage increases.
Despite the raise, Dawson expressed his concerns about accepting an additional $8,800 while acknowledging the financial challenges faced by many Canadians. He compared the simplicity of electronic payroll systems in deducting federal taxes to the process of implementing or halting a pay raise, which he believes should be straightforward.
As a gesture, the first-term MP has been donating his raise to charity but insists on his right to object to the raise entirely. House of Commons Speaker Francis Scarpaleggia and Janse declined to comment on the matter through their spokesperson, Olivier Duhaime, who mentioned that comprehensive legal arguments are anticipated to be submitted within the next two months.
