Investigations are underway into the practices of eight companies regarding their online pricing strategies, with an additional 100 businesses expected to receive warnings. The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.
The Competition and Markets Authority (CMA) is focusing its investigations on the transparency of fees displayed online, potential misrepresentation of time-limited offers, and the automatic inclusion of optional charges without customer consent. Specific concerns include additional charges on ticket-selling platforms like StubHub and Viagogo, the presentation of fees on driving school websites, the handling of joining fees for annual gym memberships, time-limited sales practices, default opt-ins, and more.
The CMA emphasized that these inquiries are based on suspicions of consumer law violations and that no final decisions have been reached. These cases mark the inaugural use of the CMA’s enhanced consumer protection powers. The authority is also reaching out to 100 other businesses to address issues related to additional fees and sales tactics.
CMA Chief Executive, Sarah Cardell, stressed the importance of ensuring consumers can shop online confidently, without encountering misleading prices or pressure selling tactics. She reiterated the commitment to cracking down on unlawful conduct to safeguard consumer interests and fair business practices.
Representatives from AA Driving School and Viagogo have expressed willingness to cooperate with the investigations. The Mirror has sought comments from Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct. It is noted that BSM Driving School is part of AA, while Viagogo and StubHub share a parent company.
